purchased a "North Face 2 in 1 Gore-Tex Jacket- Summit Series" from him. Knew it was a fake right out of the box when I got it. He claims he didn't know it was fake and I told him I had it verified by 2 employees at TNF Store. He took it back and refunded me the $150 I spent on it but now he has the same listings up again and nowhere in them is he disclosing the fact that they are knockoffs which is pretty shady in my opinion.
Anyway, thought it would be courteous to others to share the info so he doesn't rip someone else off.

You're correct, those jackets are more than likely to fakes. As far as I know, TNF has never made anything like them.
Unfortunately, the word of employees at TNF store does not constitute legal proof. That's why we recommend that buyers send their items to TNF for verification and legal proof. Without it, eBay and PayPal cannot do anything. The seller can easily deny that his items are fakes, and continue selling. If he received proof, and continued to sell and mail his items, then that would be mail fraud.

interesting... so I would have to send the fake to TNF and lose my money on returning the item for him to get any kind of penalty?

What do you mean exactly by lose your money on returning the item for him? TNF will always return the item and a letter of verification.
You are only out money for shipping to TNF and return shipping to the seller (You'll bear this cost in any event).
Sending fakes to TNF for verification is generally a good idea, since it more or less guarantees a refund even without the consent of the seller.

There is a big picture here, more than just the few bucks you might be out for shipping the item to TNF.
We try to stay focused on the big picture.
And I believe we are making some headway. There are many current examples where, with proper documentation, and proper communication with PayPal, victims are being permitted to take items to local police or not even required to take any action with the counterfeit item at all, and they still get their money back from PayPal.

ok that makes a bit more sense. I was under the impression you wanted me to turn it into TNF and they kept it, thus I wouldn't be able to receive a refund on my payment. If I ever do come across another fake (which I pray I won't) then yes, I will contact paypal and take it to TNF for actual verification.

Here's another seller with fake jackets. He did refund my money right away. I didn't leave him bad feedback but I am going to report the auction.
