Paypal really needs to work on their 'counterfeit' refund/return policy.

We're only getting the seller's side of the story there so it is a lot slanted toward pity for the seller.

However, regardless of whether or not it was documented a fake, destruction of the item is stupid.

Put then, we've come to know paypal and I can't way I am surprised.

I agree, destruction of items by anyone other than the proper authorities is a bad idea.

I wonder if Paypal has opened themselves up to lawsuits.

There doesn't appear to be any need for legal proof of counterfeits; only Paypal's "sole discretion".

I wonder how enforceable this section of the user agreement is. I doubt it's really enforceable in all jurisdictions.

I'd say it's not enforcable...
But as far as I can see, there is no such policy in the ToU of PayPal over here in Germany.
